an orange county trademark copyright lawyers humorous take on infringement

Friday, February 27th, 2009

To a great many people in Southern California, the law regarding infringement of trademarks, copyrights or intellectual property in general is so confusing, it is humourous. Whether you live in Santa Ana, CA, San Diego, Huntington Beach, Orange County, Palm Springs, Palm Desert, or Newport Beach, you are as likely to be confused by the law of infringement as someone who lives in La Jolla, Anaheim, Irvine, Westwood, Santa Monica, Westminster, Mission Viejo, Newport Beach, Buena Park, Ontario, Rancho Cucamonga or Yorba Linda. The standard for whether there has been an infringement by one person of another’s intellectual property, namely their patent, trademark or copyrighted work, often comes down to whether there is the “likelihood of confusion” in the public. To test this test set forth by the courts and by statutes, I went out into the public to see how readily the public was confused. I didn’t have to go far to find confusion. I found a dog walker trying to find an address. “Can I help you find something?” I asked her. “I’m confused,” the dog walker said. “I thought 64th street would be right after 63rd street.” “They put another street between the two,” I said, “just to confuse people like you.” “Figures,” the dog walker said. Clearly, the city was guilty of infringement on a person’s senses and well being. I next went into a coffee shop that wasn’t one that I normally went into. But instead of having the normal choices of tall, grand and venti, this shop had single, double and triple. I could see that I wasn’t the only one confused. I asked the person standing in line ahead of me, “Is a triple three times the size of a single, or is it the same size but with three shots of espresso in it?” “Beats me,” the person said. “What I want to know is what these low-fat sticky buns have that could possibly make them low-fat.” I wondered, with such confusion among members of the public, was this coffee shop infringing on either the other coffee shop’s terminology or were we, the public, just naturally confused about things. I decided I needed to see someone really smart, so I went to see a professor who was in part responsible for the new atom smasher and the super collider to see if he was faring any better than the rest of us. “Professor, can you clear up some confusion the public is having?” I asked. “I’ll certainly try, but first I’m having difficulty understanding how some news channels can ignore facts when they report the news.” “We all wonder that,” I told the Professor. “But they simply report dogma, assume that their opinions are correct and arbitrarily reject anything to the contrary. Or worse, they simply state what they want to believe and sprinkle it with a few facts.” The Professor was clearly confused. “Is that how we scientists should be doing our work? Reject any type of testing or experimentation or observation to develop our theories?” I left the Professor in a highly agitated state of confusion. Clearly the news anchors were adding to the public’s confusion. I found myself wandering inside the mental ward of the local hospital for some clarity. “Are you confused?” I asked one of the patients. “Not at all,” he replied. “I know who I am today and even if I think I’m someone else tomorrow, I still won’t have any doubt about it.” “What if you think you’re me tomorrow?” I asked. “I still won’t be confused,” the patient said. “What you feel is up to you. Like they say, I’m okay, You’re okay. Who cares if anyone moved the cheese.” I left the mental ward feeling much better about things. Confusion is in the eye of the beholder. The infringer isn’t the one confused. He may cause confusion in others, but the infringer is actually quite happy with him or herself. At least some of the public appeared not to be confused, even if they might only be the ones believing they are someone else. choosing jewellery by fashion

Friday, February 27th, 2009

When it comes to choosing jewellery, the reason it is so important to get it right is because with a single jewellery set it can transform your whole outfit into a classic and elegant one suitable for any occasion. But when a dress or top is too beautiful to be overpowered by a particular necklace, the most important accessory to wear turns into the earrings. This is not a negative impact on your outfit however, as earrings are not only the item that people are most focused on when talking to you, but they can also be chosen to your benefit by complimenting your skin and hair colour and making your eyes look dazzling. When looking at this seasons fashionable earring collections, it seemed that pearls in combination with gold colours are among the favourites. If you’re thinking you’d like to follow the fashion this time of year, a good tip would be to balance out your pearls and gold with outfits of a dark shade, such as a little black dress and lace, or mix with browns which are often complemented with rich gold tones. The effect of this seasons earrings are extremely detailed. They are mainly designed in dark (except from the cream of the pearls) or gold colours and either use small detail or big and glamorous, nothing really in-between. So it seems that diamonds are not really big this time but it terms of the designs of diamond earrings they are becoming an ‘all rounder’ feature in which you can wear them every season and on most occasions, or simply just to match your diamond engagement rings. When wearing a nice outfit the best way to match your style of earrings is to always go with the opposite of what your outfits doing. If the look is overpowering or highly detailed then go for something more subtle such as stud diamond earrings or ones of a plain design, or if your outfit seems a little bland, splash out with some huge, chandelier styles full with glitz and glam. The key is to not be afraid, if it’s in fashion, you can’t be wrong! If you were looking for jewellery sets but without the necklace, why not go for combinations in earrings and rings instead? With a little black number, diamond sparklers in your ears matching your diamond rings and even bracelets, you’re bound to be the head turner of any party …and its still not OTT!! Earrings can be and look however you want them to with the right combinations and attention to detail. Sometimes an outfit choice can turn out best if you start with the earrings and work your way down! With earring designs you’ll be spoilt for choice.

an interview with an intellectual teacher

Thursday, February 26th, 2009

AN INTERVIEW WITH MUNIR MOOSA SEWANI Interviewer: Mr. Salman Noorallah and Miss Salima Moosa Sewani Teaching is not a profession of last resort. It’s a profession of dedication. Teachers are the leaders of every nation. They are the role models of their students. Their responsibilities towards teaching are increasing day by day, as students are highly concerned about what is taught to them by their teachers. Teachers are the only one, who moulds the future of their students by imparting quality education with intellectual openness. There are many teachers, who might have impressed you by their communication or by their teaching style. But there’re only few teachers in this world, who are bestowed with both intellect and talents. They are the one, who makes us feel as if they are our real parents. Below given interview was taken by me from one of the rising teacher of our Nation. He is of one of the most attractive and one of the most famous and eminent teachers of this era. Though he is young, but his 8 years of teaching experience has not only changed the lives of many students, but his personality can not be compared with any other teacher. It was an honor for me to take an Interview of such high caliber teacher. He is non other than, Munir Moosa Sewani. You might have heard his name on national and International websites, newspapers, and magazines. Let me give you his short bio, which has been taken by me from one reputed International Educators website. Munir Moosa Sewani is one of the famous, prominent and creative names in the field of Education since 8 years. He is a Master Trainer In Special Education, Post Graduate, Teacher, Master Trainer, Career Counsellor, Professional Writer, and a Freelancer. He is an author of the famous self-published storybook for children named as “THE MORAL STORIES FOR CHILDREN”; a book, which won BEST E-BOOK FOR CHILDREN AWARD by Nancy Fernandes Institute in 2006. He has also written Biology course book for Secondary Classes. He has written almost more than 30 articles on social, health, educational and cultural issues, which are internationally recognized and published on most of the famous world wide websites, magazines and newspapers. He is also a Social worker, private tutor, musician, lyrics writer and have countless multi- dimensional talents. His future plan is to write dozens of informative books and articles and to work for the improvement of education. Could you please tell us something about yourself? My name is Munir Moosa Sewani and I am 24 years of age. I am a simple, conservative, somewhat introversive, but broad-minded person. I am a helpful and a kind person. For more, you should ask my students, or my relatives. When did you decide to enter the field of Education? I always had a wish to work for the improvement of the Education System of Pakistan. When I was in my school, I usually felt that the field of Medicine is best for me. But some how as time passed, I realized that I have keen interest in the field of Education. So it had not happened magically. Every thing was planned in my mind. When did you start your teaching career? I started off by giving tuitions after my Matriculation. That is how I started my teaching career. Could you please tell us some of your achievements in the field of Education? Simply, I got many awards, medals and certificate for my services. I got fifth position in my Intermediate. I got 2 awards from Governor of Sindh till date. I got more than 10 certificates from different officials till date. My first book won the best seller book title in the field of Science. My e-book has already won Best e-book title. If you would like to know more, you can search Internet. It’s all there. We have heard that you mostly ignore good offers from great Institutions of Education. Is that true? I don’t want to make any political comment. Simple, It’s true that I got many offers, but I am currently studying as well. Till date, I am surviving in this long journey of education because of my dual perspective. I am earning money through my part time teaching and supporting my studies. So till I achieve and satisfy my needs of Education, I would prefer to wait for joining any institution. Are you a Dictator? No way! I am a humble teacher, who teaches with lots of dedication. If the student is co-operative, a teacher could work hard to polish their skills easily. Else, all the attempts might end in smoke. Sometimes my students feel as if I am showing my dictatorship; but they know that I have true and kind feelings for them. I want to make their future bright. Nothing else! Do you think that teaching is a difficult profession? Teaching is the specialized field of education, and it requires proper education, training and inborn adoration for children. It’s not an easy profession. Time has gone when those, who did not get good job opportunities, shifted themselves in the field of teaching, in order to earn livelihood. Today teaching is a professional liberal art field. Teaching requires skills that can be brought out by taking professionals certifications or degree courses. Teaching involves being with children or with colleagues to design syllabus or problem solving too. For me, this field is not difficult. What are the flaws in our education system? There are countless flaws in our education system. Government is declaring that our literacy rate is been increasing, but I guess it’s slowing down. Education is the key towards success for every country. It helps to boost the economy and to generate democratic society in a country. The main resource of any country is Human Resource. If we’ll prepare educated human in our society in advance, by providing proper education facilities to our younger generation, then we could move towards the path of success undoubtly. If we look towards our education system, there are many unveiled reasons behind the de-motivation and poor academic performance of students. Despite a great deal of effort since from the day of independence, academic achievement among students in Pakistan continues to lag behind. No doubt that we are moving towards the successful future, but our education system some how, is hampering the progress of our country. The results, which we see in matriculation, intermediate and graduation are not up to mark. The interest in students to achieve quality education is de-motivated in the recent years. The only thing student require, is Certificate/Degree with passing marks. In the attempt to improve school results, the teacher educators and education counselor are trying their level best to find the roots of poor academic achievement of school students. Educational Psychologist has also developed many tests, to judge and improve the skills of students, but the real cause has not been founded till date, that what makes the student frustrated to back out of education so easily? Might be it’s the fault of Ministry of Education to develop lack of integrated curriculum and wrong dimensional policies or it might be the fault of a teacher, whose teaching style is not appropriate to the age level students they teach, or its the problem of Learning Disability in a child. Some point the finger at the outrageous homework loads students given by the teachers. Students are overburdened with academic demands of questionable value and, as a result, end up indifferent to studies, exhausted, and worn out.In addition, the heavy loads of books are not worthwhile, until and unless the students are ready to go through it. Our Curriculum Ministry is trying to develop curriculum according to their own judgments, without keeping in view the taste and level of a student. The reason for the poor academic achievement could be any out of these . But the question is, why the student’s academic records are more successful in European and American Countries? The answer is that, they are keen to learn and explore things. No over load of work is given to them nor books load and examination pressure is exerted on them. The books are well integrated too. The new writers, who want to write curriculum books according to the requirement of students, are never encouraged in our country. Teachers, even sometimes avoid researching, and teaches whatever is given in the textbook. The main contributing factors that lead to low learning proficiency of students according to my experience as a teacher are as follows 1. Incomprehension of the Studying Purpose The main reason why so many students don’t feel interested in what they are doing at school is the incomprehension of their studying routine. A vast majority of private and government teachers are not even bothered to explain to their students what the learning outcomes are, why they need to achieve them and how they will be assessed. Mostly Teachers take out their textbooks and start making a wrong impression of rote learning on students, and then evaluate their students without seeing the capabilities of a child. Students are not encouraged to write their own answers. Despite of it, teacher wants their student to copy the same answer in the examination, which they have taught or were made to write. Thus, the writing and analytical thinking skill gets hamper, for which we can’t blame a student. Student just accomplishes their tasks by command, which needs to be bluntly carried out. Students prepare projects; submit reports etc just to get extra marks, without knowing the purpose of their study. 2. Wrong Assessment Process Assessment means to evaluate children capabilities, not to judge them. Assessment in Pakistan is often wrongly intended by teachers as a punishment for students, or traps to catch them out. Grades seem to exist in order to show students’ errors, mistakes and drawbacks in the study area, rather than to give students reasonable chance of demonstrating their achievements of specific learning goals. Same five years questions, wrong curriculum development by the ministry of education, changing of the course at the last moment of the end of the year are going on in secondary and higher classes. Assessment should not be based on counting the pages, which a student fills. Rather than this, evaluating system should be changed. Invigilators should be well educated to judge the learning tasks and own input, else the wrong assessment process, which is going on since a long time would create a fearful attitude in students towards assessment. Students are learning not for acquiring knowledge but for getting a “pass.” Students, who works hard gets low marks, because the teacher checks the paper according to their knowledge and often forgets student effort of contributing towards answering question. 3. Lack of integrated Curriculum Ministry of Education is making such a curriculum, which is not up to mark and is not well integrated with full resources. Mistakes in the books and wrong statements makes student furious. Activities are always missing in our curriculum books. The quality and the presentation of book make jack a dull boy. Professionals make our curriculum, but the question is, why the curriculum is not made yet, according to the needs and requirement of the students? We are just trying to change our curriculum all the time on the basis of the prevailing fear of any other examination systems, coming ahead in the competition. If we are capable, why don’t we move ahead rather than taking wrong decisions at the end moment? 4. Teachers Fault With classes consisting of more than 15-20 children, many students feel deprived of the due attention on their teacher’s part. Teachers are the leader and a role model for every student. Every student wants to be unique and want his or her place in teachers’ heart. They are placed among the great lot of students without their personal interests, and problems with studying being taken into account. As a result, students don’t feel cared about, lose their identity, become indifferent to studies and lose faith in the brighter future. Teacher should treat their student equally and give proper attention to every student of his/her class. 5. Wrong attitude of parents Many parents are “performance oriented,” which emphasizes results such as students’ grades, rather than knowing whether their child have mastered the material or not. They just want their child to be on the top of the list and that’s all. Children get frustrated, when parent keeps a lot of expectations from them. It burden zed student and de-motivated them most of the time. There are many parents, who tells their child in advance that they have to join their fathers or forefathers business after passing school, which also makes student less motivated to perform well in examination and thus, poor performance is seen in the results, just because of the wrong impression embossed by parents on their children. If you were not a teacher, what would you have been? A Film Director or a Singer Which articles have you written so far? I have written more than thirty articles so far. They are educational, social and health based. You can find few of them on any search engine. Type Munir Moosa Sewani and search my name. Every month, you will find new pages on search engines. While for new articles, you should read newspapers and International magazines. What are your hobbies? I like social working, reading informative books, chatting with intellectual people, watching TV, critically commenting on burning issues, writing poetry and concepts, writing articles, playing piano, cooking, recycling, playing tennis, photography, movie making, and lots more. Could you please tell us few Couplets, which you have written? “May nay tujh ko chaha khud say bharr k uss say bhaar k, May nay tujh ko yaad kiya har pal pal apna samjh k, Mujhay kya mila dukh ansu tapkay zehr ban k.” “May nay tou uss say muhabbat he ki thi, Uss ki he khaatir buraaee bhe jee thee, May nay tou dhokay ka tasawwur na laaya, May nay tou chahat ko manzar pay paaya, Phir us nay kee kyon baywafai, Aisay kaisay dil ko gaali daar kiya, Zalaalat say tu nay mujh ko maar diya, Aisay kaisay dil pay sheehsha gaar diya, Zalaalat say mujh pay tu nay waarkiya.” Do you want to keep your self in the profession of teaching forever, or have you planned to change your field? I like this question very much. Well, truly, I am a person having most of the talents related to Media. You just name it, and I have it. Singing, piano playing, lyrics writing, music composing, concept and script writing, directing, set designing, documentaries and movies concepts, etc; i don’t know why I have such talents, which are contradictory to my nature. Although I am very much attracted towards working for media, but I guess Media is for me but I am not for Media. I am a very shy person, which most of the people don’t know. It’s almost impossible for me to adjust in any environment easily especially I don’t like to attend marriages, festivals, parties or outings. That is a part of my nature, which I can’t blame. It doesn’t mean that I am proud; no way!! I am a down to earth guy, but I like my nature very much. I am consulting my heart, and hope so soon I will make up my mind for media too. As far as other field is concerned, I don’t know about my mind. I want to taste every field. At least, I have decided to be in the field of education for two more years. Then I will decide about the future. But as time will pass, writing, teaching and media will surely go side by side in my life. Any tips for the students!!!

american notes

Monday, February 23rd, 2009

As progressing through the book American Notes: Journey created by Charles Dickens people who read it may perhaps have second thoughts if Dickens possibly stretching the truth. Moreover, Charles Dickens does not in fact give full accounts of the USA for the reason that his adventures took place mostly on the East Coast of the country but he visited no places further inland and did not witness all the multiplicity in America. I suppose that Dickens’s purpose in creating the book about the United States of America (American Notes) was to create an attractive, attention-grabbing, but truthful account of Americans lifestyle and America itself for the public in the United Kingdom. For the most part his other literary works were fictional, consequently I believe that this was no more than a personal preference of his to make a trip to the United States of America. I do believe that the strongest points of his American Notes is that it is so brightly depicted and detailed by Charles Dickens, that the author pulls the person who reads just exactly into every single situation as though they witnessed each and every occurrence of the book. Despite the fact that the images make the literary work very amusing, for my part it was difficult to recognize what he was implying for the reason that he made a lot of references to things or states of affairs of every day life that were typical for the 1840s, however, not in our time. Charles Dickens is a well-known and qualified author, but his odd style does not go well with the kind of book which would have stood a long test of time. On the condition that the American Notes was a truthful as well as indifferent account of the United States of America it would stand the test of time, however, it is full of useless information. future of elearning in india

Monday, February 23rd, 2009

What is the future of eLearning in India? Is the educated mass of India aware of what eLearning is? Does off-campus education has an edge over traditional method of learning or students still prefer classroom teaching? Which is more useful in this growing competitive world? These are significant questions to consider and central to education system in India but none of us has an exact answer to any of these questions. Learning is a continuous activity and in today’s competitive world skills get outdated within a few months. In order to climb up the ladder of success one has to keep on acquiring new skills on a regular basis. In India, the number of learners is growing rapidly but there is a dearth of competent teachers. At this point of time online learning, eLearning or CD-based learning, which is fast approaching in India, has emerged to supplement classroom teaching and provide learners just in time learning. Internet has brought people across the globe together. People can register for any university online and take up different disciplines without having to go to a different place. With the advent of different modes of education like online education and distance education, learning has become flexible, anytime and anywhere. It has become geography independent, learner centric and cost effective. Of late, corporate sectors are embracing eLearning at a rapid pace. It is not only cost effective to provide training to employees via online training materials but it also saves a lot of time and employees can learn on the job without having to devote any extra time to hone new skills. Online learning materials come with various games and interactive ways to engage the learners. Therefore, the new mantra is ‘learn while having fun’. Fun games, quiz and other interactivity in eLearning study materials not only help learners to enjoy learning but in a way, it is trying to create a niche for itself in the traditional system of education. Simulation through games is proving to be a more successful mode of training rather than theoretical education. To conclude, eLearning has a long way to go and it is quite possible to address various learning needs using online knowledge delivery systems. People who are involved in this industry should try to provide authentic training materials to sustain the faith of the educated mass in online education, only then eLearning and online education will thrive in India. write about both sides of the story

Saturday, February 21st, 2009

There are two sides to every story so in order for you to give the most to your reader explore both sides to the experiences you are sharing. Let your reader choose the side they want to be on. We can only give the information and then take a hands off approach. Your reader will make the final decision. For the side that you prefer to be the one they choose, it is up to you to give the most in depth explanation so your reader can join with you. Being believable with your writing is the key to that. If you were ever in debate club in school or knew of others in your class who were, you might remember that you were not always in favor of the topic you were assigned to defend and had to spend some time researching to be sure you had enough facts to actually defend the topic. Well, life is very much like debate club. We are always faced with topics that we need to research to be able to make a decision if they are accurate and apply to our lives or not. If you make looking at both sides of a story fun, it is easier and quicker to get to the decision point regarding the information you are presented. If you can do that in your writing, your reader will stay engaged with your content and continue on to the next chapter. Creating curiosity is another way to keep a reader engaged, but, for now just apply the gathering information on both sides of the story and begin to apply that to your writing. Your story lines will blossom and for the characters in your non-fiction work you will be able to create very interesting plot twists.

Making money online seems too good to be true. Making millions of dollars in just a few minutes a day is probably impossible, but making money online is a very attainable goal. No, you probably won’t make millions in a month, but it is possible to make a few bucks or, if you work really hard, a full time income. If you want to make money online, you need to know what to look for. There are programs that can make you some extra cash or ways to make some serious income. You can start your own business, but if you have no experience on the internet and don’t have any money, it might not be the best place to start. If you want to make money without starting your own business, there are many ways to do so. There are tons of websites that claim they will make you money. Some will and some won’t. You can write articles and be paid for each article or for each view, you can get paid to take surveys, or you can get paid to fill out offers. If you love to write, I would suggest joining a program that pays you to write. Some of the best article writing sites are Associate Content and Helium. Associated content pays you $3 to $20 per article if it is approved. You can still get it published even if it’s not approved and approved or not make $1.50 per 1,000 views. If you have several articles, you can get more and more page views and get paid more money. Helium is a little different. They only pay you for page views. It has a unique feature where you rate other articles. You can choose a topic and write about it, even if 100 people already wrote about it. You can write informative articles or even short stories. Other writers rate the articles and the closer you are to number 1, the more page views you will get and the more money you can make. They also have a marketplace where you can sell articles for $16 or more. If you aren’t much of a writer, there are lots of great get paid to programs, also known as GPT programs. You sign up for different offers by filling in your email and other information. They pay you 50 cents, $1, or more for each offer you do. Some offers are free trial offers that can pay you up to $20. You can do credit card offers, or you can do just free offers and still make a lot of money. My favorite GPT sites are Cashcrate and Swatcash. If you put in the time and really try, you can make as much money as a part time job but without the boss and strict hours. You just need to know where to look. Once you’ve found the right program, you can start making money online today. Give it a try!
